Information on processing the personal data by Lyten Poland Sp. z o.o. for employment candidates

 

This document is addressed to individuals applying for a position at Lyten Poland Sp. z o.o. (Lyten) and contains information on how Lyten processes personal data for the purpose of assessing candidates’ suitability for employment.

 

The data controller

Lyten is the controller of the personal data that it processes about you in connection with potential commencement of employment relationship between you and Lyten.

 

Categories of personal data

We collect and process the personal data you provide for us when you apply for a position we offer. The other sources from which we collect personal data are outlined below under "Where do we collect data about you”.

Personal data we process includes:

• Basic information such as your name and any current or previous place of work and job title.
• Contact details such as address, e-mail address and telephone number.
• Details in CV and cover letter.
• Information required to conduct IP check and compliance check.
• Other information you choose to share.
• Information obtained from third parties, such as correspondence with referees, typically including data relating to education, performance and professional experience, qualifications, personal characteristics, and social media activity.

Providing personal data is voluntary, but necessary for the recruitment process. Failure to provide data will result in the inability to participate in the recruitment process.

 

Where do we collect data about you

In addition to collecting data from you, we collect data about you via:

• Previous employer or other references (upon your consent).
• Publicly available sources, including authorities and social media platforms (upon your consent).
• Third parties that conduct IP checks (upon your consent).

 

Purpose and legal basis for the processing

For the purpose of evaluating your chances of obtaining employment and, where applicable, for the purpose of offering you employment and entering into an employment contract with you.

Legal basis:

art. 6.1.c of the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – "GDPR") in connection with art. 22(1) of Polish labor code – legal obligation to which the controller is subject;

in the scope not required by the legal provisions – upon your consent.

For the purpose of conducting IP check, and compliance check – upon your consent.

For the purpose of creating an account in Lyten's IT system for employees – in case of the decision to hire you – upon your consent.

For the purpose of establishing, exercising or defending legal claims that may arise from a recruitment process.

Legal basis:

art. 6.1.f of GDPR – Lyten’s legitimate interest in establishing, exercising or defending legal claims.

 

Retention period

We will retain your personal data for the purpose of assessing your employment prospects for up to 6 months from the date of your application.

We also keep the data necessary for the establishment, exercise or defense of any legal claims that may arise from your application for as long as regulations require us to keep the data.

 

Who may have access to your personal data

We may share your personal data with trusted IT and cloud service providers with whom we have entered into agreements to ensure that your personal data is processed in accordance with this information.

We will provide your personal data to the third parties that conduct IP checks and compliance tests.

Due to the cooperation of Lyten with its affiliates and service providers established outside the European Economic Area, your personal data may be transferred to the following non-European Economic Area countries: United States of America.

In order to ensure an adequate level of security of the personal data transferred to states in relation to which the European Commission has not issued an adequacy decision, the Controller uses standard data protection clauses adopted by the European Commission, referred to in art. 46.2 c) GDPR or other adequate measures.

The standard clauses are available on the Internet, on the European Commission website (ec.europa.eu).

 

Your rights

Subject to the respective legal requirements, you can request Lyten to:

• Provide you with access to the personal data concerning you that the respective data controller is processing (Art. 15 GDPR),
• Rectify inaccurate personal data concerning you (Art. 16 GDPR),
• Delete or restrict the processing of personal data concerning you (Art. 17, 18 GDPR),
• Provide you or a third party designated by you with a copy of your data (Art. 20 GDPR).

You have the right to withdraw your data processing consent regarding the processing based on art. 6(1)(f) of GDPR, i.e. your consent; however, it has no impact on the lawfulness of the processing of personal data before the withdrawal of such a consent.
